We live in a culture where the government sees people as guilty until proven innocent.

This cop should be fired immediately. Issuing death threats to someone with a burned-out license plate light? Officer Merrill, while you were needlessly harrassing this poor individual for 28 minutes, there was probably at least one house burglary in your immediate vicinity that went unpunished. But I'm sure you'd prefer to deal with church pastors than with real criminals. You're such a MAN!

It's this kind of brainwashed scum that is destroying America. They have no business being on the police force.

Bravo! I watched all 28 minutes on the edge of my seat, wondering if the police would force you out of the car then beat you senseless. I believe your video camera saved all of you from that fate. These traitors... yes UNIFORMED, BADGED BANDITS, and TRAITORS to OUR constitution were so far out of line I fear the only retribution they'll see is a pat on the back from their commanding officer. I am pleased you held your ground... You won! So much for 5 seconds. And the ticket... Fix the light and it's dismissed. That's the real sad part of this story... A burned out tail light, and probable cause is extended to gun running and drug trafficking. -- Side note: You do have the right to have an attorney present during a search. I was in a similar situation, telling the officer it would be fine to search my car... Just as soon as my attorney arrived. If you can not afford an attorney the state must provide one. The officer let me go without a search.

I guess you aren't familiar with Romans 13, Pastor.

1Everyone must submit himself to the governing authorities, for there is no authority except that which God has established. The authorities that exist have been established by God. 2Consequently, he who rebels against the authority is rebelling against what God has instituted, and those who do so will bring judgment on themselves.

Maybe next time you'll read your bible.

1. That is NOT what Romans 13 says. Here is what it actually says:

Rom 13:1 Let every soul be subject unto the higher powers. For there is no power but of God: the powers that be are ordained of God.
Rom 13:2 Whosoever therefore resisteth the power, resisteth the ordinance of God: and they that resist shall receive to themselves damnation.

2. I was not the one in violation of the law. The police officer was the one who THREATENED TO KILL ME, which is "aggravated menacing."

3. The "higher power" in the United States is the constitution, which is the supreme law of the land.

Watched the vid today. Ridiculous!!! And they handcuffed you?!?!

Also listened to a follow-up vid on youtube where a guy called the PD to leave a complaint. The receptionist was clueless! He kept calling him "pirate Merrill" and the lady was like, "huh?". While the situation isn't funny, the call kind of was.

What was the outcome?

Ticket or warning for the plate light?

Other charges to driver/passengers?

What took place while the driver was cuffed and stuffed?

Some serious threats were made concerning "obstruction" charges, predicated on the officer's claim that the dog couldn't properly search an occupied vehicle. The K9's certification is checkable, probably exposing the officer's story as a lie.

Pastor Anderson, how do you plan to follow up this incident?

I did not receive a citation for the light, and the passengers were not charged with anything. As soon as the video ends we basically just drove away in peace.

I'm going to file a written complaint against the officer for "aggravated assault."

What a horrific experience! If I didn`t see it on video I wouldn`t believe this could happen in a country that is a synonym of freedom for other countries in this world.

You -and your wife- seem to fight for liberty and freedom. So can you HELP? Have you heard of the cause of Elisabeth Sabaditsch-Wolf from Austria in Europe? She apparantly just quoted verses from the quran and is now on trial for "hate speech". Just for Saying things like “Sharia is a definite no-no. We want no gender apartheid, no ghettoes, no social and cultural discrimination, no polygamy, no theocracy, no hate…”(http://gatesofvienna.blogspot.com/2010/10/bpe-press-release-on-elisabeth.html#more).What do you think of this? Thank you.

You should have presented him with a good Gospel message. Would have been a better use of your time.

Overall, I have no problem with Pastor Anderson standing up for his Constitutional rights. The idea that standing up to the government when they are in clear violation of the law being somehow unchristian or a violation of Romans 13 is absurd. When the government is violating the law, that law being the higher power (and the Constitution being the highest legal power in the US), then civil disobedience becomes a Christian duty.

My only problem is in the 00:50-01:00 area. Questioning you if you have a weapon in the car is legally dubious, especially for the nature of the stop, though I am not sure what the law there is specifically. (In Michigan, that is a question that you cannot legally be required to answer, even for legal weapons, unless they are licensed concealed pistols. If the weapon is NOT concealed (such as locked, cased, empty, and in your trunk), there is no obligation to declare it OR show the police.

Without knowledge of the local law there, however, I cannot say if your state also legally allows you to refuse answering such. By refusing, though, you may have reasonably triggered circumstances legally allowing the officers to remove you from your vehicle for their own safety. (There is a Supreme Court decision that allows that as not a 4th amendment violation, but the allowances, from what I've seen, are very slim, and there may be no way to have legally triggered such in your case due to the nature of the stop. By refusing to answer when you did, you may have needlessly escalated what was, up to that point, the officers baselessly escalating a 20 second stop into something much more.

Outside of that minor issue, I have a fairly firm conviction that you did everything right. (I would include, considering your past, trying to ascertain the officer's intentions for wanting you out of the vehicle and attempting to make sure you wouldn't be attacked again.)

Overall, I have to agree with your 01:47 sentiment that, "This is insane." There is certainly no doubt from this video that you were never a threat to the officer's safety, and that their entire escalation of the incident arose from your simple choosing to stay within your rights. There was never justifiable grounds for the officers to draw weapons on you, let alone threaten you with them.

I listened to your sermon about your border patrol incident and how jesus felt being persecuted and beaten..

Very apt analogy.

How can it be a border patrol if it is within the US territory ?

You seem to get your fair share of trouble with authorities. Maybe they will avoid you from now on due to all the bad publicity they are getting... Best of Luck and God Bless !!

What response did you get from the Benson PD about your complaint ?
